LAND REGISTRY ORDER

In the matter of a Caution lodged by John Stanley Weekes on Block 14/11 Parcel 26 in the name of PETER BARZEY of Sweeney’s, St.John’s, Montserrat

and

In the matter of an application by INEZ BARZEY (Grand Daughter of PETER BARZEY) for the Removal of the said Caution.

 

The Registrar of Lands has been requested by INEZ BARZEY to remove the caution on the above mentioned title.

AND WHEREAS   a Notice was sent to JOHN STANLEY WEEKES at his last known address on June 18, 2002 informing of the Registrar’s intention to remove the said Caution if an objection was not received from him by August 1, 2002.

WHEREAS, the above parcel is currently registered to Abraham Adam Silcott.  The registration was obtained by prescription and included a survey dated 29th March 1997 of the area claimed.  This survey was unapproved.

AND WHEREAS, the parcel was previously sold by Ann Silcott to Charles Robert Allen on 13th October 1965.

AND WHEREAS, under section 139 (1b) of the Registered Land Act the Registrar has authority to rectify the register in cases where any person has acquired an interest in land by prescription under part 1X of the Registered Land Act.

AND WHEREAS, plot #2 can be identified as lying within the Underwood Estate with registered owner as Edgar Mortimer Allen.

I HEREBY ORDER, that parcel 14/20/4 be reduced in size to the area as shown as plot #1 on survey plan dated 29th March 1997 and that the register be corrected to give ownership back to the rightful registered owner as shown in Liber J Vol 1 folio 716-721 – Charles Robert Allen.

That plot #2 on survey plan dated 29th March 1997 be returned to its rightful owner being the heirs of Edgar Mortimer Allen of Underwood Estate.

Be it known that: Pursuant to Section 139 part x of the Registered Land Act 1978 and Section 151 and 152 part xi of same act. 

 

The Registrar of Lands advises the public that the boundaries of the land as described above will be subjected to review by the Registrar of Lands over the next few weeks in order to determine the original boundaries of the Estate of Edgar Mortimer Allen.
